What Does Oklahoma Law Say About Fault?

Oklahoma follows comparative negligence under 23 O.S. § 13. You can recover as long as your share of the fault was 50% or less, and your award is reduced by your percentage.

On the water, a rule violation becomes evidence of negligence. Under 63 O.S. § 4210, no operator may run a vessel recklessly or negligently, overload it beyond the capacity plate, exceed posted speed limits, or come within 50 feet of another vessel at more than 10 miles per hour. Boating under the influence is separately illegal at 0.08 under 63 O.S. § 4210.8.

Operators also have duties after a crash. Under 63 O.S. § 4214, they must render reasonable assistance, report the accident promptly, give identifying information in writing to anyone injured, and file a report with the Department of Public Safety when there is death, injury, or property damage above $2,000.

What Deadlines Apply to a Ketchum Injury Claim?

Most Oklahoma injury claims carry a two-year deadline under 12 O.S. § 95, and wrongful death claims run two years from the date of death.

Claims involving a government body are different and much tighter. The Governmental Tort Claims Act generally requires written notice within one year of the loss under 51 O.S. § 156. The entity then has 90 days to respond, and suit generally must be filed within 180 days of a denial. Because the Grand River Dam Authority is a state agency, and because a town or county may be involved in a road or property claim, this deadline is worth checking at the start rather than the end.

Economic damages such as medical bills and lost wages are not capped, and wrongful death claims fall outside the caps entirely.
